Notarizing Housing Transaction and Contracts

Housing transaction, contracts need to be notarized:
+ Housing purchase and sale contracts between individuals
+ Housing giving contracts between individuals
+ Housing mortgage contracts
+ Housing renting contract of individual with over 6-months term
+ Inherited property dividing minutes
+ Inherited property declarationế.

A. Notarize composed transaction, contract

1. Notarizing document of Housing transaction and contract
- Application of request for notarizing (supplied by Notary Public Agency)

- Copy of Housing Ownership Right document
- Copy of Identity papers

2. Formality of notarizing
- - Step 1: Participants submit documents to notary and should bring original document for comparing
- - Step 2: Notary receives document and records into Notary Book
In case of clarifying related issues, participants are asked to explain or investigate, examine. If participants cannot explain, notary will return document
- - Step 3: Notary checks the draft. If content is illegal, requester is asked for editing the draft. If the draft is not edited, it will be returned.
- - Step 4: Participants review the draft and sign contract. Notary certifies contract.
- - Step 5: Requesters hand in notarizing fee and receive notarized contract

B. Notarize transaction, contract composed by notary

1. Notarizing document of Housing transaction and contract
- Application of request for notarizing
- Copy of Housing Ownership document
- Copy of Identity papers

- Step 2: Notary will check. If participants meet conditions of participating transaction, contract will be set up. If necessary, notary will investigate, examine.
- Step 3: Participants review the contract and sign if they agree. Notary certifies contract
- Step 4: Requesters hand in notarizing fee and receive notarized contract. Period to notarize is not over 2 working days. For complicated contract, this period is maximum 10 working days. Investigating, examining time is not included in notarizing period.
