Transaction of Housing trade
A. Housing trade associating with land use right
1. Document of Housing trade submits to Housing Management Agencies including:
- Trade contract certified by the Notary
- Documentary proof of housing ownership such as Certificate of housing ownership and Land Use Right, Certificate of housing ownership, Land Use Right with housing record…..
- Tax Declaration of transferring land use right and Declaration of housing and land registration fees (supplied by Housing Management Agencies in the reception point)
For individual to be overseas Vietnamese, copy of valid passport granted by Vietnam or origin certificate Vietnamese citizen is a must

2. Procedure and formality of Housing trade:
- Step 1: Buyer and seller sign contract in Notary Public Body (without discrimination of areas) , enclosing documentary proof of housing ownership, identity papers. Contract can be composed in advance or be done by Notary.
- Step 2: One of both sides hands in document of Housing trade in district-level Housing Management Body( for individual), province -level Housing Management Body ( for organizations).
In case of partial housing trade associating with Land Use Right, it must have sketch map of size of house and land. It must be verified by Housing Management Body( in urban area) or be confirmed by commune-level people’s committee ( in rural area).
- Step 3: Relying on document, Housing Management Body will check, define location of land, then, send to Tax Agency to determine financial obligation ( if any).
- Step 4: After receiving tax agency’s announcement, Housing Management Body will send notice of tax payment to owner to do his financial obligations.
- Step 5: After having paid tax, owner submits receipt of tax payment, registration fee to Housing Management Body to receive Certificate of housing ownership and Land Use Right.
Procedure of granting Certificate of housing ownership and Land Use Right for buyers is maximum 30 days as upon receiving enough valid documents. This procedure does not include the time that owner does financial obligation.
According to law, provinces, cities will have particular regulations of formality of housing ownership transferring, to be suitable with each local.

B. Housing trade without right of land use
1. File of housing trade includes:
- Certificate of housing ownership is granted according to Housing Law (there is only housing ownership on other’s land such as building house on renting land).
- Housing trade contract must be certified by Notary.
- Declaration of housing registration fee payment
For individual to be overseas Vietnamese, copy of valid passport granted by Vietnam or origin certificate Vietnamese citizen is a must.

2. Procedure and formality of Housing trade
Procedure and formality of Housing trade is similar to Housing trade associating with land use right mentioned in part A.
In this case, seller does not pay tax for transferring Land Use Right and buyer hands in registration fees (by 1% housing value, according to law).
Buyer only possesses house in the term written in Certificate of housing ownership.
